1. About these terms
These Terms & Conditions explain the rules for using the MACALY online store and purchasing our products. By browsing this website or placing an order, you agree to these terms. If you do not agree, please do not use the website. MACALY is a London-based luxury gifting store. References to “MACALY”, “we”, “us” and “our” mean the business operating this store; “you” means the person using the website or placing an order.
2. Products, personalisation and availability
Our products are made or finished with care and may include handmade variations in colour, texture, sizing or finish. Product photographs are for illustration and colours may appear differently on different screens. You are responsible for checking names, dates, spelling, artwork, quantities and other personalisation details before submitting an order. We may contact you to clarify an order. Personalised proofs must be approved by you where we provide them. We may correct an obvious listing error, update product information or withdraw a product before accepting an order.
3. Orders and acceptance
Submitting an order is an offer to buy. Your order is accepted when we send an order confirmation or begin preparing the goods, whichever occurs first. We may refuse or cancel an order where a product is unavailable, a pricing or listing error has occurred, payment cannot be authorised, delivery information is incomplete, or we reasonably suspect fraud or misuse. If we cancel after payment, we will refund the amount paid for the cancelled order.
4. Prices and payments
Prices are shown in the currency displayed at checkout and may include applicable taxes where stated. Delivery charges, minimum order quantities and any custom charges will be shown before you place your order. We may change prices at any time, but a change will not affect an order already accepted. Payment must be made using an available payment method at checkout. Card and wallet payments are processed by secure third-party payment providers; we do not store your full card number. We may verify payment and order details before dispatch. An order will not be dispatched until payment has been authorised, unless we have expressly agreed another arrangement such as cash on delivery.
5. Delivery
We deliver to the locations shown at checkout. Dispatch and delivery times are estimates and may vary because products can be made to order, especially for personalised or larger event orders. You must provide an accurate delivery address and ensure someone can receive the parcel where required. We are not responsible for delay caused by an incorrect address, failed delivery attempt, events outside our reasonable control or a carrier issue, although we will provide reasonable assistance. If a parcel arrives damaged, please contact us promptly with photographs and your order details.
6. Cancellations, refunds and faulty goods
Because personalised and made-to-order products are prepared specifically for you, they may not be eligible for cancellation or change once production has started, except where the law gives you a right or the product is faulty. For non-personalised goods, you may have a statutory cancellation right under applicable UK consumer law. If goods are faulty, materially different from their description or damaged before delivery, contact us at hello@memorise.co.uk as soon as possible. Depending on the circumstances and your legal rights, we may offer a repair, replacement, price reduction or refund. Approved refunds are normally returned to the original payment method, and processing time may depend on your bank or payment provider. Nothing in these terms limits your statutory consumer rights.
7. Intellectual property and customer content
All website content, including the MACALY name, logos, product photography, copy, designs, graphics, layout and software, belongs to MACALY or its licensors and is protected by intellectual property laws. You may view the website and make a personal, non-commercial use of it. You must not copy, reproduce, republish, sell, modify, distribute or commercially exploit our content without written permission. You retain ownership of photographs, logos, names and other material you provide for an order, but you give us permission to use it only as reasonably needed to produce, quality-check, fulfil and support that order. You confirm that you have the right to provide it and that our use for those purposes will not infringe another person’s rights.
8. Prohibited use
You must not use the website or our products to break the law, infringe another person’s rights, submit fraudulent or misleading information, upload unlawful, hateful, abusive or harmful material, interfere with the website or its security, introduce malicious code, scrape or harvest information without permission, attempt unauthorised access, resell access to the website, or place orders using another person’s payment details without authority. We may suspend access, cancel orders and report suspected unlawful activity where appropriate.
9. Liability
We will provide the website and products with reasonable care and skill. To the fullest extent permitted by law, MACALY is not liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of data arising from your use of the website or an order. We are not liable for events outside our reasonable control. Our total liability for a claim connected with a particular order will not exceed the amount you paid for that order, except where the law does not permit that limitation. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of your statutory consumer rights, or any other liability that cannot legally be excluded or limited.
10. Website availability and links
We aim to keep the website accurate and available, but we do not promise that it will always be uninterrupted, error-free or free from viruses. We may update, suspend or withdraw a feature without notice where reasonably necessary. Links to third-party websites are provided for convenience; we do not control or endorse their content, availability or privacy practices.
11. Governing law and contact
These terms are governed by the laws of England and Wales. If you are a consumer, you will also have the protection of any mandatory rights available to you under the law of the country where you live. The courts of England and Wales will have jurisdiction, subject to any mandatory consumer rights that allow you to bring proceedings elsewhere.
